“Associate Member” means husband, wife, father, mother, brother, sister, son, daughter, son-in-law, daughter-in-law, nephew, niece a person duly admitted to Membership of a housing society on written recommendation of a Member to exercise his rights and duties with his written prior consent and whose name does not stand in the share certificate. This written recommendation is given in form no 5. (to be suitably changed as per amended MCS act 1960)
As per Section 154B (10)(6) of MCS act 1960, The Associate Member shall have "RIGHT TO CONTEST THE ELECTION TO THE COMMITTEE" with prior written consent of a Member.
As per section 154B(11)(2) of MCS act 1960 The Associate Member shall have "RIGHT TO VOTE WITH PRIOR WRITTEN CONSENT" of a Member.
As per sec 154 B - 10 (7) Any action contemplated against the original Member in the Act shall be applicable to such an Associate Member.
Associate Member however has no stake in the property of the society. Ownership of property remains intact with owner only.
Any one of the 12 relatives specified above can apply for associate membership by submitting appendix 5 and 10A.
Appendix 5 (suitably amended) is application for associate membership with consent from the primary member. This application will give the associate member right to attend society meetings in the absence of the primary member. Associate member can take part in discussions and also vote in all these meetings.
Appendix 10A (suitably amended) is NOC and undertaking from primary member given to associate member to enable him to take part in society election and get elected to MC and even become office bearer.
The new forms after the amendment of MCS act in year 2019 are not yet published so one must submit old forms with necessary corrections. The MC members should understand this and accordingly guide members.
Along with application the associate member will pay Rs 100 membership fee.
On receipt of application for Associate Member Secretary will take this application on agenda of next MC meeting. The same is discussed in the committee meeting and approved by committee members present in the MC meeting. After approval name of associate member it will be recorded in "J" register ONLY ( NOT in "I" & Share registers & Share Certificate ).
